Driving Under the Influence of Alcohol Offenses
DUI offenses in Roanoke/Botetourt
Driving Under the Influence offenses are extremely case specific. The outcomes of DUI cases will vary based upon the Blood Alcohol Content (BAC); interaction with the officer; severity of the driving and prior offenses.
At a minimum the following punishments are required if convicted:
· DUI 1st Offense

$250 fine

5 days in jail is mandatory with a BAC between .15-.20 OR 10 days in jail with a BAC greater than .20

One year restricted license

Ignition Interlock mandatory with BAC over .15 (6 consecutive months with no violations required)
· DUI 2nd Offense within five years

$500 fine
-
20 days in jail (additional mandatory 10 days with a BAC between .15-.20 and an additional 20 days for a BAC over .20)

Ignition Interlock for no less than six months (6 consecutive months with no violations required)
